Common Instances of Medical Malpractice
Medical malpractice is a common kind of personal injury lawsuit in which the negligence or intentional oversight of a doctor or medical professional actually hurts rather than heals a patient. Although this might not seem like it would happen too often, medical malpractice is a very common occurrence in the medical community and manifests itself in a variety of ways, all of which create grounds for a personal injury lawsuit.
One of the most common instances of medical malpractice is that involving misdiagnosis. This occurs when a doctors fails to diagnose a disorder, or diagnoses one incorrectly, and this leads to the person getting worse or otherwise suffering further than if the disorder was diagnosed correctly. There is a caveat to this, of course, as sometimes medical mistakes do happen and the doctor might not have all the information necessary to properly diagnose or the symptoms are not apparent. It is only considered misdiagnosis if it was medically reasonable that the doctor should have made the correct diagnosis, but didn’t.
Another common instance of medical malpractice is a careless mistake in prescribing, or in some cases not prescribing, the correct medication. If a doctor should prescribe a certain kind of medication and doesn’t or prescribes the incorrect dosage and it causes further complications or pain, this could be considered malpractice as well. Obviously this falls under the terms of “within medical reasonability” as well.
There are other situations of medical malpractice that are less common, but are very relevant in certain cases. Mishandling of pregnancy or infant delivery is a major one that can cause great harm to both mother and child. If a careless mistake is made during surgery, either involving anesthetics or the surgery itself, there may be grounds for a medical malpractice case as well.
