Deadly Cement Silo Accident Leads to Consequences for Two Florida Employers

Cement silos can be dangerous workplaces, but they are necessary for industrial-scale concrete production and storage. OSHA Cites Two Companies After Fatal Cement Silo Incident 

Back in August of 2023, a fatal incident occurred at a cement silo in Fort Lauderdale. A worker was attempting to repair a conveyor system when the machinery unexpectedly activated, causing fatal injuries. After an investigation, OSHA determined that the employer committed a number of safety violations in connection with this incident.

First of all, the employer failed to provide the worker with proper communication. With better communication, OSHA argues, this accident could have been prevented. In addition, the employer was accused of not implementing proper lockout procedures. They also apparently failed to inform relevant parties of property safety protocols.

The machinery reportedly started up because one of the companies failed to develop “energy control procedures” that would have saved the worker’s life. In addition, the employer was accused of failing to conduct periodic inspections – and these inspections would have prevented the machinery from activating unexpectedly.

OSHA issued a statement in connection to this incident:

“This tragedy is a reminder of the importance of properly developed and implemented lockout/tagout procedures. Employers and contractors must assess the hazards before anyone touches the machinery and must use lockout/tagout procedures to prevent serious injuries or death.”

 As a result of these citations, the companies have been ordered to pay over $80,000 in penalties. It is not clear whether these funds will be provided to the family of the deceased worker. This certainly seems like the most appropriate course of action – especially given the financial burdens most families struggle with after losing loved ones to workplace accidents. One can only assume that the family filed a workers’ compensation claim on behalf of the decedent to pursue death benefits.
