How Long Does it Take to Receive Workers Comp?
Any time that an employee is injured while in the workplace, he or she is eligible to receive financial compensation from the employer to cover the medical costs of that injury. This program, appropriately known as workers’ compensation, is a right extended to all employees and you should always file for it with your company’s human resources department as soon as possible after the injury. After you file, how long does it take to see the actual workers’ comp benefits?
Once a workers’ compensation claim is approved, the first check should be in your hands within 14 days. That is, of course, assuming that the claim is approved right away and there are no complications or questions that arise. This unfortunately is what delays a lot of claims by weeks or even months in some cases. It is important, when submitting your claim, to be very careful about writing out all medical information and citations of the incident. Ideally, you only want to have to submit a claim once and not get bogged down in having to make multiple revisions.
Once you get your first workers’ compensation check, there should be another payment made to you minimally every two weeks. If you do not receive your benefits on time, once the payments begin to come in, you are entitled to an additional increase on further delayed payments. This doesn’t happen too often, but you would want to capitalize on any good fortune that comes as a result of this.
Workers’ compensation is a right and if your employer or insurance company tries to deny this of you, you have grounds to file a lawsuit to see benefits granted to you. When going through this process, we at the Franco Law Firm are here to help you navigate the legal battlefield and see justice won for you.
